Ministry of Environment, Forest and Climate Change (MoEF&CC) has notified amendments in Hazardous waste rules known as “The Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022”, to include provisions for utilization & management of waste tyre. The amendments have provisions for the utilization & management of waste tyres through the regime of Extended Producer responsibility.

Extended Producer Responsibility (EPR) is based on the principle of “Polluter Pays”.

EPR is a concept to promote environmental sustainability and ensure the responsible management of waste generated by products throughout their lifecycle. In India, EPR is primarily governed by the E-Waste (Management) Rules, 2022, the Plastic Waste Management Rules, 2016, the Battery Waste Management Rules, 2022, Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022. These rules are implemented by the Ministry of Environment, Forest and Climate Change (MoEF&CC) and regulated by the Central Pollution Control Board (CPCB) at the national level. State Pollution Control Board (SPCB) is the State-level body to implement EPR and monitor activities related to that.

Overview

The Management & Utilization of Waste Tyre will be based on the principle of Extended Producers Responsibility (EPR) where the Producers of the Waste Tyres will be assigned EPR obligations on the basis of quantity of tyre manufactured/ sold or imported by it.

Recyclers and Retreaders under the rules are mandated to generate and issue EPR Certificates based on quantity of waste tyre recycled or retreaded by them. Further for fulfilment of EPR obligation, Producers are required to purchase EPR Certificate from registered Recyclers. The quantity of EPR certificates purchased will be adjusted against EPR obligation. A Producer may also buy Retreading certificate for deferment of its EPR obligations, however the obligations will only be considered fulfilled once the Recycling certificates are purchased.

Meaning of Producer and Recycler

Producer

A Producer means any person or entity who:
  • Manufactures and sells new tyre domestically; or
  • Sells domestically under its own brand, new tyre manufactured by other manufacturers or suppliers; or
  • Sells imported new tyre; or
  • Imports vehicles fitted with new tyres; or
  • Automobile manufacturers importing new tyre for use in new vehicles sold domestically; or
  • Imports waste tyres.

Recycler

Any entity involved in the process or action of converting waste tyre into following end products, in an environmentally sound manner:
  • Reclaimed rubber
  • Crumb rubber
  • Crumb rubber modified bitumen (CRMB)
  • Recovered carbon black
  • Pyrolysis oil or Char

Retreading means the process of renewal of tread and sidewall rubber of a worn-out tyre having a good structural quality
Under the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022, a producer shall be responsible for fulfilment of extended producer responsibility by purchasing extended producer responsibility certificates from registered recyclers only. The producer shall be responsible to file annual and quarterly returns on or before the end of the month succeeding the quarter to which the return relates and each registered entity shall have to file the quarterly return.
All the recyclers shall submit on monthly basis the information regarding the quantity of waste tyres used and end product produced, extended producer responsibility certificate sold, and such other relevant information as required. All the recyclers shall file annual and quarterly returns on or before the end of the month succeeding the quarter to which the return relates.
The Central Pollution Control Board (CPCB) will assign EPR obligations to a producer based on the quantity of tyre manufactured or imported by it. Based on the quantity assigned in EPR obligation, producer will accordingly purchase EPR certificate from a registered recycler. A producer can also purchase retreading certificate from the registered retreader for deferment of its EPR obligations.
On production of retreading certificates, the EPR obligation shall be deferred by 1 year for the corresponding quantity of waste tyres. Provided that the obligation shall be extinguished only after end-of-life disposal through a registered recycler.
